Lab Design has been designing and manufacturing laboratory furniture for well over 40 years. Terms and Conditions

All contracts arising out of the placing of Buyer’s order and the acceptance thereof as herein provided shall be binding upon the successors and assigns of Buyer and Seller, shall be deemed entered into at Burlington, New Jersey, and shall be governed by and construed in accordance with the Uniform Commercial cod, as adopted by the state of New Jersey, and/or other applicable law of said State. All provisions of the following conditions are separate and the invalidity of one or more parts shall not effect the validity or enforceability of any other provision or part.
Your order having been accepted, acknowledged, and place into production by United Hospital Supply Corp. cannot be cancelled without our written consent. Requests for cancellation after the date shown on the acknowledgment copy are subject to the following (a.) 50% re-stocking charge for any standard unit returned to us pre-paid displaying our authorized return label on the face of the shipping container, after the approval of our inspection dept. Modified or specially produced products cannot be cancelled, and if returned without our knowledge shall be subject to a monthly storage charge, beginning 10 days after written notice by us of the items arrival at our plant, at the rate of $3.00 per square foot of floor space per month.
Terms: Net 30 days
Prices shall be those in effect at the time of shipment, unless given in writing by the sales manager, and only for that specific period of time as provided for within a formal quotation. Price lists are issued as sales aides only, and should not be construed as a formal offer to the buyer.
For any given section, prices are for all products within that section to be delivered with one shipment and installed at one time.
In the interest of maintaining the highest standards of quality, and performance, United Hospital Supply, reserves the right to make changes in the technical and dimensional specifications of its products without prior notice. It shall be the complete responsibility of the buyer to detail to t the seller his specific, full specifications, and requirements beyond the use of the seller’s model numbers, which are not offered as a warranty of technical and dimension specifications, but as partial product description and heading, to be more completely denied by the seller upon the buyers request. Responsibility for expenses incurred as a result of product changes or discontinuance, shall lie solely with the buyer.
All delivery dates are estimates of our ability to provide time and materials for the production of our products at a point in time before buyer places his order, conditions may arise that prevent compliance with delivery schedules, in any and all such occurrences the Seller shall not be liable for any damage or penalty for delay in delivery, or failure to give notice of delay, and such delay shall not constitute grounds for cancellation. At their option, however, the buyer and seller may wish to establish certain considerations for assurance of any specific delivery schedule or date, such as, but not limited to, bonuses, premiums, or other agreed remuneration’s to the seller, beyond his normal product pricing and/or sales terms.
Routing your shipments will be made at the discretion our Traffic Dept. unless otherwise specified on the face of your order.
Sales are mad F.O.B., our plant, Burlington, New Jersey, and title to the goods passes to you upon deliver to the carrier. Seller’s total responsibility ceases upon issuance of a bill of lading or delivery to transportation company. It is your responsibility to promptly inspect goods upon receipt, and make all claims directly to the delivering carrier.

Warranty

UHSC/MacBick/Lab Design items are warranted to be free from defects in materials and workmanship for a period of one (1) year. The liability of UHSC/MacBick/Lab Design under this warranty will be limited to repair or replacing the equipment. In the event the lab casework and fumehoods would be defective in any way due to workmanship or materials, please contact your nearest local UHSC/MacBick/Lab Design Representative. Your UHSC/MacBick/Lab Design Representative will determine whether the equipment may be repaired in the field, must be returned to UHSC/MacBick/Lab Design for correction or must be replaced. To any event, the correction or replacement will be made at no charge to you. UHSC will pay all freight charges for warranty repair. Defects or malfunctions arising from misuse or improper maintenance of the equipment are excluded under this warranty. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. UHSC/MACBICK/LAB DESIGN SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some states do not allow an exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you special legal rights and you may also have other rights which vary from state to state.
